42 on Sonneblom (Pty) Ltd (The Deli) does not provide any warranty or guarantee as to the absence of pips, stones, hard pieces, or other naturally occurring elements in any food products supplied. The inherent nature of certain food products may contain such elements, and the responsibility for removing or managing them lies with the purchaser.
1.2 Baking Mixes:
Baking mixes are provided with suggested instructions and guidelines for preparation. However, baking results can vary depending on individual ovens, baking techniques, and ingredient substitutions. The Deli cannot guarantee perfect baking outcomes and takes no responsibility for variations in texture, taste, or appearance of baked goods made with our mixes.
1.3 Allergies:
Food allergies are a serious concern, and The Deli strives to provide accurate ingredient information on all products. However, due to potential cross-contamination during manufacturing and handling, the complete absence of allergens cannot be guaranteed. It is the sole responsibility of the purchaser to carefully review ingredient lists and allergy warnings before consuming or serving any product.
2. Limitation of Liability
The Deli shall not be held liable for any damages, direct or indirect, arising from the presence of pips, stones, hard pieces, or other naturally occurring elements in food products. Additionally, The Deli is not liable for any adverse reactions or allergic responses resulting from the consumption of food products, even if those products were labeled accurately.
3. Indemnification
The purchaser agrees to indemnify and hold harmless The Deli from any and all claims, losses, damages, and expenses (including reasonable attorneys' fees) arising out of or in connection with:
- Any allergic reactions or other health issues arising from the consumption of food products.
- Unsatisfactory baking results using our baking mixes.
- The presence of pips, stones, hard pieces, or other naturally occurring elements in food products.
4. Governing Law and Dispute Resolution
These terms and conditions shall be governed by and construed in accordance with the laws of South Africa. Any dispute arising out of or relating to these terms and conditions shall be settled by arbitration. The parties agree to submit their dispute to a neutral third party (arbitrator) who will make a binding decision. Each party will be responsible for its own legal or any other expenses arising from the arbitration.
5. Entire Agreement
These terms and conditions constitute the entire agreement between the parties with respect to the subject matter hereof and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.
6. Severability
If any provision of these terms and conditions is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
7. Amendment
The Deli reserves the right to amend these terms and conditions at any time by posting an updated version on its website. Any changes will be effective immediately upon posting.
